Kerala High Court ruled in favour of 33-year-old social activist Rehana Fathima as Justice Kauser Edappagath said that painting on the nude upper body of a mother by her own children “cannot be characterised as a real or simulated sexual act nor can it be said that the same was done for the purpose of sexual gratification or with sexual intent”
The HC bench further noted, "The right of a woman to make autonomous decisions about her body is at the very core of her fundamental right to equality and privacy. It also falls within the personal liberty guaranteed by Article 21 of the Constitution.”
Rehana Fathima faced charges under the Protection of Children from Sexual Offences (POCSO) Act, Juvenile Justice Act, and the Information Technology (IT) Act for posing nude in front of her children
A few weeks ago a video went viral where activist Rehana Fathima was seen posing semi-nude in front of the mirror while her minor children were in the same room. The video received a lot of backlash on social media
Rehana Fathima has asked her children to paint on her semi-nude body in a bid to send out a message about female nudity. However, it did not go down well with the netizens as they blamed her for engaging in inappropriate behaviour with her minor children
Following the allegations of ‘sexual exploitation', Rehana Fathima shared on social media that she wanted to convey how the naked upper body of the female is sexualised in all contexts, whereas the naked male upper body is not treated to this default sexualisation
Talking about the viral video, Kerala HC’s Justice Edappagath said, “There is nothing to show that the children were used for pornography. There is no hint of sexuality in the video.”
As per reports, Fathima used to work as a technician at BSNL until 2020 when she was forced to resign due to some reasons. She often participates in gender-related protests
Rehana Fathima came to the limelight in 2018 when she attempted to enter the Lord Ayyappa shrine in Sabarimala after the Supreme Court allowed women of menstruating age to do so. As per reports, she was criticised for doing so based on both her gender and religion
