The terms and conditions as set out herein ("Terms") provide the rules for the participation in Business Today & Thomson Reuters Top 30 Finance Global Capability Centres (GCC(s) in India' Listing (hereinafter referred as "BTTRTTFGCCI"). These Terms constitute a legally binding agreement between Living Media India Limited ("India Today Group", "we", "us" or "our"), which operates the Business Today website ("Website")and each participant of the Top 30 Finance GCCs/ GCC in India participating in BTTRTTFGCCI ("GCC", "you" or "your").

By participating in the Top 30 Financial GCCs in India and/or accessing, browsing, or otherwise using the Website, you are indicating your agreement to our Terms, Website terms and conditions and our privacy policy, our partner's privacy statement (https://www.thomsonreuters.com/en/privacy-statement.html) and any other policies or guidelines as may be applicable (collectively, "Policies"). If you disagree with any part of the Policies, then you should discontinue access or use of the Website. Please read the Policies carefully before proceeding.

1. BTTRTTFGCCI is an initiative of Business Today (BT), a brand of Living Media India Limited, carrying out business as India Today Group ("ITG") and Thomson Reuters South Asia Pvt. Limited ("TR"). ITG and TR will jointly own all rights, title, interest, and all related intellectual property rights in BTTRTTFGCCI listing or any derivatives of it. GCC shall have no ownership right in the BTTRTTFGCCI listing.
2. The Top 30 Finance GCC(s) in India will be published in the BT magazine and www.businesstoday.in. BT aims to build this as an annual study to publish the most definitive list of the Top 30 Finance GCCs in India that have centralised the finance function.
3. BTTRTTFGCCI is supported by knowledge partner, Deloitte Touche Tohmatsu India LLP or DTTI LLP, as published on the website. All rights reserved
4. A GCC can submit its nomination here. (The nomination can be done by a designated employee/director of the GCC company who has the legal capacity to nominate, represent, submit the application, certify and be responsible as the single point of contact.)
5. Screening of applications/ nominations will be undertaken by BT, TR & Deloitte Touche Tohmatsu India LLP or DTTI LLP before they are submitted to an independent jury constituted by BTTRTTFGCCI.
6. The evaluation will be undertaken by the jury based on the shortlisted application forms, submitted by each GCC.
7. All the applications/nominations must be true and correct along with updated business venture/organisation. The designated employee/director of the company submitting the application must be above 18 years of age as on [1 April 2022].
8. Subject to clause 17 (use of information) all material provided by GCC will be treated in strict confidence and will not be shared with any third party except to facilitate judging of entries by the jury, or for a disclosure required under law or regulation.
9. Incomplete applications/ nominations received without completing the mandatory fields, or providing incorrect information, will make the application/nomination form invalid and it shall not qualify for the BTTRTTFGCCI listing. ITG and/ or TR shall not be required to provide any intimation to an applicant, in this regard.
10. The last page of the application form is to be duly signed by the head/authorised signatory of the GCC along with the company stamp. A scanned copy of the signed last page must be uploaded by the GCC on the website
11. Entry to BTTRTTFGCCI does not require any fees.
12. All entries to BTTRTTFGCCI must be completed and uploaded on Website before midnight of 31st March 2023.
13. The designated employee/director of the Company agree to be bound by the decisions of the jury. No correspondence, telephone, email or communication of any kind will be considered in relation to the decision of the evaluators and jury. Jury's decision will be final.
14. All material submitted in support of application/nomination is warranted by the designated employee/director of the Company to be their property and is entered without any encumbrances by third parties.
15. To the extent permitted by applicable law, GCC agrees to defend, indemnify and hold harmless India Today Group & Thomson Reuters, its affiliates, officers, directors, employees, agents, and applicable business partners, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (a) GCC's use of the Website; (b) GCC's violation of any term of the Policies; (c) GCC's violation of any third party right, including without limitation any copyright, property, or privacy right; (d) any claim that the GCC's participation caused damage to a third party; or (e) any claims arising out of any material, statements or claims made as part of the entry. This defence and indemnification obligation will survive the termination of the Terms and use of the Website.
16. The designated employee/director of the Company, agree that the selected jury/ panel of the BTTRTTFGCCI is entitled to judge their application/nomination and select what they consider to be the Top 30 Finance GCCs in India without any recourse to the designated employee/director of the Company.
17. The designated employee/director of the Company may only provide information that they own or have the right to use. GCC remains the sole and complete owner of all information provided by it at the time of filing the application/nomination. However, by submitting its application/nomination, GCC grants to ITG, TR and Deloitte Touche Tohmatsu India LLP or DTTI LLP a worldwide, non-exclusive, royalty-free, transferable, sub-licensable licence to use its name, image and contributions for marketing of BTTRTTFGCCI, including but not limited to, articles in newspapers, magazines, websites, social media posts, blogs, the Website, and displaying the name and other details of the winners and/ or other presentations related to BTTRTTFGCCI on television and other ITG TR owned/ operated platforms.
18. BTTRTTFGCCI reserves the right to withdraw an entry from the evaluation process at any time if the entry is deemed inappropriate for any reason without assigning any reasons whatsoever. Decision of ITG and/ or TR, and/or evaluators/ Jury shall be final and binding.
19. ITG reserves the right not to conduct the BTTRTTFGCCI listings at its own discretion and without recourse to the GCC.
20. If the name of the designated employee/director of the Company/ contact person changes, BTTRTTFGCCI must be informed immediately in writing at financegcc@intoday.com . Failure to do so shall lead to the entry being disqualified.
21. Shortlisted GCCs may be required to provide additional information upon request from BTTRTTFGCCI, within stipulated timelines. Failure to comply will lead to the application being disqualified.
22. Entry deadlines and other timelines may be extended at the discretion of ITG, without assigning any reasons.
23. All the applications submitted after the timelines defined herein shall be treated invalid and would not be eligible for evaluation.
24. A GCC may nominate itself under more than one parameter/ process, as provided for under the application form, by checking the relevant fields and filling out the prescribed details. However, only one application form per Company/ GCC would be eligible for evaluation. In case multiple applications are submitted by designated employee/director of the Company, only the first entry submitted would be considered valid for evaluation.
25. ITG and TR reserve the right to change any process, evaluator or jury member at their discretion and without any prior notice or providing any reasons for the same. No queries would be entertained with regards to any changes made and ITG and/ or TR will not be held liable for any such changes.
26. The designated employee/director of the Company agree to be contacted by ITG and/ or TR/Deloitte Touche Tohmatsu India LLP or DTTI LLP for the purposes of communication (via email, phone, video call or post).
27. All entries will be judged on the information provided at the time of entry. Additional amendments or comments, if shared by an applicant, may or may not be accepted for the purpose of BTTRTTFGCCI listing at the sole discretion of ITG.
28. The parameters for the BTTRTTFGCCI listing are based on the decision by the partners, Jury and ITG and will consider each entry/ submission against the eligibility criteria and their own discretion based on their relevant expertise.
29. The Website and all content associated therewith, are provided 'as is' and 'as available' with all faults and without warranty of any kind. To the fullest extent permissible pursuant to applicable law, India Today Group and its owners, directors, officers, employees, agents, affiliates, licensors, and business partners expressly disclaim any warranties, express, implied, statutory, or otherwise, including non-infringement. India Today Group does not warrant that this website and the content provided through it, to be available, accurate, useful, or free of errors, viruses, or other harmful components. You are solely responsible for any damage to your equipment, software, loss of data, or other harm that results from your use of this Website.
30. The Application, presentation and the supporting documents provided by the GCC should be clear and legible. Failure to provide the same can lead to disqualification. ITG and/ or its partners and/ or the Jury of BTTRTTFGCCI reserve the right to disqualify any entries, in its sole discretion. Successful verification of the documents is mandatory for the entries to be shortlisted. ITG reserves the right to ask the GCC to re-submit any of the documents/ additional proof at any stage of the entire event.
31. The process by which the shortlisted entries are informed of their shortlisting may be updated by the BTTRTTFGCCI by way of updating these Terms and Conditions.
32. BTTRTTFGCCI may, at its discretion, contact the designated employee/director of the Company GCC(s), if required, for any clarifications needed for the information provided in the application registration form.
33. In case there is any mismatch of a GCC(s) details in any round of the BTTRTTFGCCI, the GCC(s) may be disqualified from further participation.
34. The GCC(s) to the extent permissible in law, shall not under any circumstances make any claims against ITG, Thomson Reuters, their divisions, their subsidiaries, their employees, their respective agents and representatives, directors and their affiliates arising out of or relating to any and all costs, injuries, for any kind of losses, damages, costs or injuries of any kind, including due to any problems caused by technical disruption and/or failure, server problems or any other difficulties.
35. The submission of application/nomination form does not entitle any kind of selection or gratification.
36. ITG reserves the right to terminate and/or postpone the publication without giving any prior notice to the GCC (s). Such decision shall be final and binding on the GCC(s) and the same shall not be disputed and/ or challenged in a court of law.
37. The GCC specifically agrees and acknowledges that any disputes or claims shall be resolved individually and the GCC agrees to not file by resort to any form of class action and/ or through any family member and/or third party applications, criminal and/ or civil proceedings in any courts or forums against ITG, their directors, employees, officers, affiliates or subsidiaries to claim any damages. Under no circumstances will ITG and/ or its affiliates, partners be liable for any consequential, indirect, special punitive, or incidental damages or lost profits, whether direct or indirect, arising in any way whether in contract, tort (including negligence) or otherwise.
38. GCC(s) agree and irrevocably acknowledge that ITG and/ or its partners, shall have the sole and exclusive right including but not limited to intellectual property rights (copyrights and trademarks). GCC(s) undertake that the GCC(s) shall not violate the rights of any third party including but not limited to privacy rights, copyrights, trademark or any other intellectual rights; shall not upload, store, collect, transmit or cause the upload, storage, collection, transmission, of any information through the website which violates any applicable laws, including, inter alia, belonging to another person; or is harmful, harassing, blasphemous, defamatory, obscene, invasive of other's privacy, paedophilic, libellous, hateful, or racially, ethnically objectionable, disparaging, harms minors in any way, violates any law for the time being in force.
39. GCC(s) agree that GCC(s) shall not indulge in any kind of activities like spamming or either directly or indirectly, reverse engineer, decompile or disassemble, make any enhancements, modifications, customisations, changes, additions, translations, deceive or mislead about the origin of such messages which is grossly offensive or menacing in nature, or allow any kind of unfair practices, ITG reserves the right to take appropriate action including criminal action in such an event.
40. ITG and TR shall not be responsible for any errors or omissions in the terms and conditions contained herein. All information provided is provided "As is" without warranty of any kind. ITG and TR make no representations and disclaims all express, implied, and statutory warranties of any kind to the GCCs and/or any third party including, without limitation, warranties as to accuracy, timelines, completeness, merchantability, or fitness for any particular purpose.
41. ITG and TR shall not be responsible for any break or disconnection or disruption and/or liable in any manner whatsoever for any network problem, unclear network, disruption in the network, connection failure, electricity failure, internet service provider, facility provider, or due to capacity constraints or any other reason whatsoever irrespective of the network being used. In addition, ITG and TR shall not be responsible and liable in any manner whatsoever in the event of any failure in the system, session failure, logging failure, close or any other difficulties of such nature due to which the GCC is charged by the telecom operator and/ or is unable to submit the Application.
42. ITG shall endeavour to make all reasonably practicable arrangements to ensure uptime of systems, back-up of data, server capacity and prevent other technical impediments, but can make no guarantee thereof and shall not in any manner be responsible for any technical problem with the internet and by participating in the present Application submission, the GCC agrees not to hold the ITG and TR liable for any such technical problem or shall have any claim in this regard.
43. While all attempts will be made to protect the Application data from loss and/or corruption, GCC(s) agree and acknowledge that all systems are prone to failure and hacking attempts. In the event of any data loss, ITG shall make commercially reasonable endeavours and may disqualify all the Applications received or re-conduct the Application process or continue with whatever data available in the manner it deems fit. ITG and TR will not be responsible for any damage resulting from the loss of data or action taken by ITG OR TR on account of the same. ITG and TR will not be responsible to make good any loss or dissatisfaction suffered by the GCC on account of such loss.
44. The GCC(s) shall comply with all the applicable laws of India. The GCC(s) shall also comply with the rules and regulations including the terms and conditions of the Website(s).
45. ITG and/ or TR reserve the right to modify, alter or amend the format, the rules and any other terms and conditions at any time, at their discretion, and will not be held liable and will not entertain any queries related to the same.
46. The aforementioned rules and regulations will be subject to the laws of India. Disputes, if any, are subject to the exclusive jurisdiction in the courts of Delhi. If any dispute remains unresolved for a period of more than 30 days from the date the same was raised (with neither party seeking more time to resolve) then the same be referred to a single arbitrator solely appointed by ITG. Arbitration governed under India Arbitration and Conciliation Act, 1996 (amended from time to time) and applicable rules thereunder.
